Terms of Service & Privacy Policy

In order to get started, please read the agreement printed below carefully then check the box to agree to the terms.

Any access to and use of the BriGarden Homeschool website and its pages (the "Site") is subject to the terms and conditions of use (the "Terms") as set forth in this document as they are amended from time to time by BriGarden Homeschool (this "Agreement"). As a condition of use of the Site you must read and understand, and agree to the Terms and this Agreement. Further, each time you access the Site you are again acknowledging and agreeing to the Terms and this Agreement, as they may be amended from time to time and as they are in effect each time you access the Site.

Terms of Service 

1. Acceptance of Terms 

The following are the terms and conditions (“Terms”) that govern your use of the BriGarden Homeschool (“BGHS”) portal (“Site”) and the Site’s contents, registration services, documents and materials available on, through or within the Site (“Contents”). If you are under eighteen (18) years of age or a minor in the jurisdiction in which you reside, you must have the permission of and be under the direct supervision and control of your parent or guardian at all times when using the Site, and you must have your parent or guardian read and agree to these Terms before you use the Site. 

By accessing or using the Site in any way, you expressly agree to be bound by the Terms and all other policies, rules and notices posted on the Site as well as comply with all applicable laws and regulations governing your use of the Site. All such policies, rules and notices posted on the Site are hereby incorporated by reference into these Terms. If you do not agree to be bound by these Terms, you must not access or use the Site. 

BGHS reserves the right to change these Terms or any other policies, rules, or notices posted on the Site at any time at its sole discretion. Your continued use of the Site after such changes have been posted constitutes your express acceptance of such changes. You are responsible for regularly reviewing these Terms. You agree to use the Site and any third-party sites that are accessible through the Site only for lawful purposes. If you breach any of the Terms, your authorization to use the Site automatically terminates, and you must immediately destroy any documents or materials you obtained from the Site in violation of the Terms. 

2. Privacy 

BGHS does not disclose its users’ personal information to third parties for the third parties’ direct marketing purposes. 

BGHS does not knowingly collect any personal information from any child under eighteen (18) years of age without the consent of the child’s parent or guardian or knowingly market to any child under eighteen (18) years of age, except as permitted by law. If BGHS discovers that a child under eighteen (18) years of age has submitted personal information to the Site without written consent from his or her parent or guardian, BGHS will delete the information in accordance with applicable law. 

If you submit, email or upload any documents, material, data, information, passwords, usernames, other log-in credentials or information or any other content to or through the Site, you agree that you are providing BGHS with a worldwide, royalty-free, and non-exclusive license to access and use such content for the purpose of providing the Site services and Contents. You agree that BGHS may use and store such content in accordance with Terms and any other policies, rules, or notices posted on the Site and applicable law. You agree that BGHS is not liable to you for any loss or corruption of any such content. BGHS takes reasonable security measures to protect user information, but no online security system is 100% secure, faultless or impenetrable. BGHS cannot guarantee the security of the Site or that the information you provide through the Site will not be intercepted online. 

You shall not disclose or share your account or password with anyone and agree to take reasonable measures to protect the security of your account and password. You will provide BGHS with accurate, complete, and updated registration information. You shall not select or use the name or email of another person with the intent to impersonate that person or use a name subject to any rights of any person other than you without appropriate authorization. You are responsible for all activity occurring on or in your account and for ensuring that such activity complies with these Terms and any other policies, rules, or notices posted on the Site. 

3. Acceptable Use
You are only permitted to use or access the Site if the following conditions are met: 

You agree to use and access the Site and its Contents for its intended purposes of educating your child only and you agree not to copy, distribute, transmit, broadcast, transfer, sell, use or access the Site or its Contents for any purpose or assist another in doing so outside of its intended purpose;
You agree not to use any Content, information, documents or materials obtained from the Site to share with another person or assist another in doing so; You agree that you will not submit, upload or contribute any Content that is harmful, fraudulent, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, or otherwise objectionable as reasonably determined by BGHS;
You agree that you will not submit, upload or contribute any Content that attempts, in any manner, to obtain the password, account, or other security information from BGHS; You agree not to decompile, reverse engineer, disassemble, damage, modify or destroy the Site or its Contents, services or functions or assist another in doing so;
You agree not to sell, rent, lend, lease, transfer, distribute or create derivative works based upon the Site or its Contents or assist another in doing so; 

You agree not to commercially exploit or otherwise use the Site or any part of the Site or its Contents for any commercial enterprise;
You agree not to upload, email, submit or transmit any material including a bot, worm, Trojan horse, spamming or scripting device or computer virus that may damage, corrupt or interfere with the Site or its Contents, services or functions or any other computer system or data;
You agree not to engage in any automated use of the Site or its Contents, such as using scripts to send emails or messages, or using any other automated tool to gather and/or extract data;
You agree not to disable, damage, modify, bypass, circumvent or interfere with any security features on or in the Site including but not limited to those designed to prevent or limit use of or access to any of the Contents, documents or materials available on or in the Site;
You agree not to use the Site or its Contents in any manner that may create a false or misleading statement or impression regarding the Site, BGHS or any other person or entity referenced in or on the Site;
You agree not to transmit any unsolicited or unauthorized advertising, junk mail, spam or other advertisement through the Site; and
You agree to comply with these Terms and all applicable laws, statutes, ordinances and regulations; 

Individuals who violate these Terms may be subject to civil and/or criminal penalties. 

4. Disclosure of Information 

The Site does not sell or carry advertising for third parties or target advertising in any way. The Site does not sell user information, and the Site will not disclose user information to third parties without the consent of the user except as required by law, as necessary to protect BGHS’s legal interests, enforce these Terms or to investigate, prevent, or take action regarding a potential violation of these Terms or an illegal activity. 

5. Copyright 

The Site and all its Contents are copyrighted by BGHS unless otherwise indicated. All intellectual property rights in and to the Site are owned by BGHS, and BGHS reserves all rights with respect to the Site and its Contents unless these Terms expressly provide otherwise. Nothing in or on the Site or its Contents shall be construed as granting any license under BGHS’s intellectual property rights to any person or entity, whether by estoppel, inference or otherwise. 

If you download or copy of any of the Contents, you must not delete, erase, modify or remove any logos or notices including but not limited to copyright notices from the item(s) you download or copy, or assist another in doing so. 

6. Trademark 

All BGHS logos, trade dress and titles displayed on or in the Site are BGHS trademarks or services marks unless otherwise indicated. All other company names, products, trade dress, logos or other trademarks on or in the Site or its Contents are the trademarks or services marks of their respective owners. Nothing contained in these Terms or on or in the Site or its Contents shall be construed as granting any license or right relating to any trademarks or service marks displayed on the Site without BGHS’s prior written consent and/or the consent of other trademark owners, as applicable. 

7. Proprietary and Confidential Information and Intellectual Property Rights 

The Site and its Contents contain confidential and proprietary information. BGHS reserves all rights including all copyright, trade secret, patent and other rights in and to the Site and its Contents unless expressly provided otherwise herein. Any unauthorized use of the Site or its Contents may violate copyright, trademark, patent, and/or other intellectual property laws or these Terms. 

8. Links and Third-Party Sites 

The Site may contain links to other websites or third-party content of which BGHS does not have ownership or control. Third-party websites contain information created, posted, published, maintained and/or controlled by other persons or entities. BGHS expressly disclaims any responsibility for any third-party website or content. If you access or use third-party websites or content, you do so at your own risk and agree to not hold BGHS or any of its officers responsible for any aspect of these third-party websites, including but not limited to their content, terms of use and/or policies. Links to third-party websites or content are provided to you only as a convenience and do not imply that the third-party websites have given BGHS permission to include these links, that BGHS endorses such third-party websites or their content, or that there is any relationship between BGHS and the third-party websites. You are responsible for reviewing the privacy policy, terms and other policies that are included on the linked or third party websites as those websites are not governed by these Terms. 

9. Disclaimer of Warranties and Limitation of Liability 

(A) DISCLAIMER OF WARRANTIES 

THE SITE AND ITS CONTENTS ARE PROVIDED “AS IS” OR “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. BGHS DOES NOT WARRANT OR REPRESENT THAT THE SITE, ITS CONTENTS, OR ANY THIRD PARTY WEBSITE OR CONTENT REFERENCED OR LINKED ON OR IN THE SITE WILL BE UNINTERRUPTED OR FREE OF INACCURACIES, ERRORS, MISTAKES, VIRUSES OR OTHER HARMFUL ELEMENTS. 

(B) LIMITATION ON LIABILITY 

TO THE FULLEST EXTENT PERMITTED BY LAW, BGHS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOST REVENUES, LOST PROFITS, LOSS FROM PROSPECTIVE ECONOMIC ADVANTAGE OR ANY OTHER DAMAGES ARISING FROM THE USE, MISUSE, OR INABILITY TO USE OF THE SITE, OR ITS CONTENTS OR SOFTWARE THEREIN, REGARDLESS OF WHETHER BGHS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANOTHER PARTY. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. 

YOU AGREE THAT YOUR USE OF OR ACCESS TO THE SITE AND ITS CONTENTS WILL BE AT YOUR SOLE RISK. THIS PROVISION WILL SURVIVE TERMINATION OF THESE TERMS AND YOUR USE OF OR ACCESS TO THE SITE. 

10. Indemnification 

You shall, to the fullest extent permitted by law, indemnify, defend and hold harmless BGHS, its affiliates, officers, directors, agents, consultants, employees, attorneys, volunteers, representatives, partners, successors and assigns (collectively hereinafter referred to as BGHS and BGHS Personnel) from and against any and all claims, suits, actions, demands, losses, costs, penalties, obligations, errors, omissions, or liabilities, including legal costs, attorney’s fees, and expert witness fees, whether foreseeable or not and whether or not suit is actually filed and/or any judgment rendered against BGHS and/or BGHS Personnel, that may be asserted or claimed by any person, firm or entity arising out of: 1) your use of or access to the Site or any its Contents; 2) your violation of the Terms; or 3) your violation of any rights of another person or entity. This indemnity and hold harmless provision shall exclude actions arising solely out of the negligence or willful misconduct of BGHS and/or BGHS Personnel. Your obligation to defend BGHS and BGHS Personnel and the other indemnities identified herein are not contingent upon there being an acknowledgement or determination of the merit of any claims, demands, actions, causes of action, suits, losses, liability, expenses, penalties, obligations, errors, omissions and/or costs. The obligation to indemnify, defend and hold harmless BGHS and BGHS Personnel will survive termination of these Terms and your use of or access to the Site. 

11. Termination 

BGHS may terminate, restrict or suspend your permission to use or access the Site or any of its Contents at BGHS’s sole discretion and without notice. BGHS may suspend, discontinue or change any part of the Site services or Content, or impose limits on certain Site services or Contents or restrict access to parts or all of the Site at any time. BGHS may destroy personal information associated with an account after cancellation or termination of the account. You may delete your account at any time. Upon termination of your account, your right to use the Site and any Content will immediately cease; however, BGHS may retain data and information contained in your account or related to your account pursuant to these Terms, as necessary for auditing purposes, and as required by law. You agree that BGHS is not liable to you or any third party for any termination of your account(s) or access to the Site. BGHS reserves the right to seek any and all remedies available at law and in equity for any violation of the Terms.

13. Governing Law 

The Site, with the exception of third party links, is owned and controlled by BGHS in the State of California in the United States of America. By accessing or using the Site, you agree that your use and access to the Site is governed by the laws of the State of California, without regard to the conflicts of laws principles thereof. You agree to comply with all applicable laws, including but not limited to all applicable export and import regulations of the United States and other countries. The sole jurisdiction and venue for any claim arising from the Site, its Contents or these Terms shall be the state and federal courts located in, or serving, Los Angeles County, California, and you hereby consent to the exclusive jurisdiction and venue of such courts. To the maximum extent allowed by applicable law, you hereby irrevocably waive the right to bring any claim, action, or suit against BGHS unless you provide BGHS with written notice of the event or facts giving rise to the claim, action, or suit within one (1) year of their occurrence. 

Except where prohibited by applicable law, all disputes arising under the Terms shall be resolved exclusively through confidential binding arbitration in accordance with the Consumer Arbitration Rules of the American Arbitration Association. The arbitrator’s award shall be binding and may be entered as a judgment in a court of competent jurisdiction. You agree that BGHS may seek any interim or preliminary relief from a court of competent jurisdiction in California, necessary to protect its rights or property pending the completion of arbitration. 

14. Waiver, Severability, Entire Agreement, Assignment and Successors and Assigns 

The Terms along with any other policies, rules and notices posted on the Site, constitute the entire agreement between you and BGHS with respect to the Site and its Contents and supersedes all prior discussions, negotiations and agreements, whether oral or written. Should any provision of the Terms be determined to be invalid, illegal or unenforceable in any respect, such provision shall be severed, and the remaining provisions shall continue as valid, legal and enforceable. The captions contained in the Terms are for convenience only and shall not in any way affect the meaning or interpretation thereof nor serve as evidence of the interpretation thereof, or of the intention of the parties hereto. The waiver by any party of any breach of any term, covenant, or condition contained herein shall not be deemed to be a waiver of such term, covenant, condition, or any subsequent breach of the same or any other term, covenant, or condition contained herein. The Terms and any rights granted under these Terms may not be transferred or assigned by you but may be assigned by BGHS without restriction. The Terms shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, legal representatives, successors, and assigns.

Privacy Policy 

Thank you for visiting the BriGarden Homeschool (“BGHS”) website and for reviewing our privacy policy. This privacy policy discloses the ways that BGHS’ website gathers, uses, discloses, and manages a website user’s personally identifiable information (“PII”). 

PII is information that can be used to discover a person’s identity. This is information like names, addresses, phone numbers, geolocation data, etc. 

Some of BGHS’ webpages contain online forms that allow you to voluntarily submit PII. In those cases, if you choose to submit your PII using these online forms, we will make every attempt to secure the transfer of your PII and your privacy. BGHS cannot provide a guarantee to the absolute security of your personal information. 

BGHS will not sell any student or parent data (or any system data). BGHS does not sell ads or use personal information obtained to carry advertising. 

BGHS regularly reviews and updates our industry-standard security practices and systems. 

If you visit the BGHS website, we will not collect PII about you unless you choose to provide that information through the BGHS website. 

If your use of BGHS’ website is limited to browsing the site, reading pages, or downloading information, the website’s operating system will collect limited non-personally identifying information your browser makes available automatically whenever you visit a website. 

This information includes the IP address of your computer or network, the date, time, and page you visited on our site, your browser and operating system, and the referring page (the last webpage you visited before clicking on a link to our site). 

We use this aggregated anonymous information from all of our visitors to measure server performance and improve the content of our site. 

BGHS will track keywords that are entered into its search function to measure interest in specific topics, but we do not associate the keywords with individual users. 

Information you provide 

If you decide to send BGHS an electronic mail message (email) through our “Contact” form, the message will contain your return email address. If you include PII in your email because you want us to address issues specific to your situation, we may use that information in responding to your request. In other limited circumstances, we may be required by law to disclose information that you submit. We take appropriate security measures to secure against interception of email. However, because we cannot provide a guarantee of absolute security of PII sent via electronic means, we advise you to include only the information necessary for BGHS to process your request. 

In addition, information volunteered by you through your filling out of our optional contact form is used to help us enhance our websites and may be shared with BGHS employees and contractors for that purpose. 

BGHS does not give, share, sell, rent, or transfer any personal information to a third party. 

However, because BGHS uses Squarespace as the portal for its application and enrollment process and Google Classroom as the educational platform for classes thus Squarespace and Google Classroom will be receiving and storing information that you provide to BGHS, please also review Squarespace and Google Classroom privacy policies prior to providing any PII through Squarespace, which can be found on their websites. 

Website analytics 

We use a tool called "Google Analytics" to help understand how visitors interact with our website so that the site can be improved. 

You can read the Google Analytics Terms of Use and the Google Privacy Policy for Google Analytics. 

You can choose not to have your data collected by Google Analytics by downloading their opt-out browser add-on. 

Third-party websites and links 

BGHS’ website includes links and search capabilities to navigate publicly available information from the websites of outside agencies, organizations that are not part of BGHS and over whom BGHS exercises no control. 

Please review the privacy policies and procedures described that apply to third-party websites prior to interacting with the site. 

We suggest contacting these sites directly for information on their data collection and distribution policies. 

Cookies 

On certain BGHS web pages, “cookies” are used to help with interactive usage of the site. A cookie is a small file that a website transfers to your hard disk, usually to keep track of you while you are connected to that site. 

The cookies on BGHS’ website do not collect information about you, but only about your browser session. The cookie makes it easier for you to use the dynamic features of these web pages, without having to provide the same information again and again as you move from one page to another. To protect your privacy, be sure to close your browser completely after you have finished conducting business with a website that uses cookies. If you are concerned about potential use of information gathered from your computer by cookies, you can set your browser to prompt you before it accepts a cookie. Most Internet browsers have settings that let you identify and/or reject cookies. 

Site security 

We monitor network traffic to identify unauthorized attempts to upload or change information or to otherwise cause damage to the site. Anyone using this website expressly consents to such monitoring. 

We take appropriate security measures to protect unauthorized access, alteration or destruction of data.
